Membership Terms & Conditions

I acknowledge that the activity I am to undertake is a dangerous activity and that by participating in it, I

am exposed to certain risk. I acknowledge and understand that while participating in such activity:

a.          I may be injured, physically or mentally, or may die;

b.          My personal property may be lost or damaged;

c.           Other person participating in such activity may cause me injury or may damage my property;

d.          I may cause injury to other person or damage their property;

e.          The conditions in which the activity is conducted may vary without warning;

f.               I may be injured or die or suffer damage to my property as a result of the negligence or breach of contract of Small Town Fitness, its owner, employees or independent contractors ;

g.          There may be no or inadequate facilities for treatment or transport of me if I am injured; For

              immediate injury assistance, I will call 911.

h.          The facility is not staffed and my activity will not be supervised by a trained professional and I

             shall exercise extreme caution to protect my self and my property from injury due to my activity

              and/or activity of others;

i.            I assume the risk of and responsibility for any injury, death or property damage resulting from

              my participation in the activity;

j.                I further acknowledge that I must give 30 day written advance notice of cancellation.  The member must fill out proper facility-provided paperwork to cancel membership, and will be billed for membership up to 30 days after the date of signed cancellation notice. 

k.              I am responsible for making my membership payments and paying all fees associated with late or returned payments. I am aware that if my automatic withdraw payments do not got through within a 15 days after the payment due date I will be charged a $25 late fee. I am also aware that if my payments do not go through I will be charged a $25 return fee.

l.           If I change or cancel my gym membership, I have two months from that date to dispute any charges that I may incur.

Release And Indemnity

I participate in the activity and enter the premises of Small Town Fitness  at my sole risk and responsibility. I release, indemnify and hold harmless Small Town Fitness, its owner, employees, servants and agents from and against all and any actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to me or my property whether

by negligence, breach of contract or any way whatsoever.

Administration

If payment is not received on the date due, membership will be suspended until membership fees are brought current; a reinstatement fee of $10.00 per month is required to reinstate any suspended membership; if a 30 day notice is given, no reinstatement fee is needed.

a.          Appropriate covered footwear and shirt must be worn at all times while in the facility.

b.          Memberships are non refundable and non transferable.

c.           All weights and equipment must be put back to appropriate location after use.

d.          Shared access to the facility with non-member will result in forfeiture of membership effective immediately.

e.          Each member must respect other gym users and behave in an appropriate manner at all times. 

f.               Small Town Fitness reserves the right to rescind the rights of members not complying with the terms and conditions of the membership.

g.          Anyone between the ages 10-14 must be accompanied and supervised by a parent or guardian at all times.

h.          Pets are not allowed.

i.                Alcohol, profanity, smoking or drug use is not tolerated. Anyone suspected to be under the influence of alcohol or drugs will be asked to leave the premises and police will be called.

j.                Small Town Fitness does not provide medical insurance for members. We strongly encourage you to consult with a physician before participating in any physical activity to determine any physical activity to determine any potential conditions that may adversely affect your participation.

k.          According to the State of Missouri, you have the right to a three-day cancellation period, cancellation due to death or permanent disability, and a freeze period.

l.               On the last day of membership, members should turn in key tag. The result of not turning the key tag(s) in will be a  $5 charge for each key tag not brought back to Small Town Fitness.

 m.       Children under 10 are not permitted in Small Town Fitness.  Small Town Fitness will not be liable for accidents

              with children.  Any damages  will be the responsibility of the member who brought the child.
